The following describes the terms under which Limits of Glory offers access to our site.
The services and products available at http://www.LimitsofGlory.com (the "Site") are owned and operated by Limits of Glory.com, LLC., a California Limited Liability Company, doing business as Limits of Glory, and are provided to you ("You") under the following terms and conditions (the "Agreement"). If You do not agree to be bound by the terms and conditions of this Agreement, do not use or access our Site or purchase any of the products or services. Limits of Glory may amend this Agreement at any time by posting the amended terms and conditions on the Site. This Agreement may not be otherwise amended except in writing signed by You and Limits of Glory.
SERVICE. Limits of Glory is a Gaming resource and Gaming Rules provider. Limits of Glory writes, edits, publishes wargame rules, periferal wargaming supplies, and provides wargaming resources, e.g., the forum, FAQ, etc. to gamers, historians, and interested parties.
USE. The content of the site is "as is", and no warranties or guarantees are either stated or implied.
TERM. This Agreement will remain in full force and effect while You use the Site and/or are a Member. You may terminate your membership at any time, for any reason. Limits of Glory may terminate Your membership for any reason, effective upon sending notice to You at the email address You provided in the registration process, or such other email address You may later provide to Limits of Glory. Even after membership is terminated, this Agreement will remain in effect.
CONDUCT. Please use common sense and reasonable practices when using the Site. You agree to provide true, accurate, current and complete information to Limits of Glory and to any third parties on or through the site when using the Site. You may not allow anyone else to use Your Limits of Glory account ("Account") and You may not use anyone else's Account while using the Site. You agree to notify Limits of Glory immediately of any unauthorized use of your Account or any other breach of security. Limits of Glory will not be liable for any loss or damage arising from your failure to comply.
PRIVACY. Solely to enable Limits of Glory to use the information You supply ("Your Information"), and so that we and other 3rd parties using the site are not violating any rights You might have in that information, You agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) You have in Your Information, in any media now known or not currently known, with respect to Your Information.
CONTENT. Limits of Glory reserves the right to post on the Site any and all text, graphics, and other media, that You provide. You hereby acknowledge that Limits of Glory shall not have any liability for how the Site is used, what Content is posted or accessed, or what products or services are made available.
LIMITS OF GLORY'S PROPRIETARY RIGHTS. You acknowledge and agree that the Site and all gaming content and rules contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that content on the Site or presented to You is protected by copyrights, trademarks, patents and other proprietary rights and laws. Except as expressly authorized by Limits of Glory, You agree not to modify, sell, distribute or create derivative works based on the Site or rules, in whole or part.
UPGRADES, SUPPORT AND NOTICES. From time to time, Limits of Glory may (and has the right to) send You information and offers about upgrades, documentation, special announcements and other services offered by Limits of Glory. Notwithstanding the foregoing, under no circumstances will Limits of Glory or any of its Partners have any obligation to provide You with upgrades, enhancements, modifications, or support for the Site.
INDEMNITY. You agree to indemnify and hold Limits of Glory, its heirs, successors, assigns, parents, subsidiaries, affiliates, officers, employees and Partners, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the following: Your use of the Site, use of Your account by any third party, Your purchase or use of products or services offered by Sellers, Your sale of products or services to Buyers, the violation of this Agreement by You, or the infringement by You, or any third party using Your account, of any intellectual property or other right of any person or entity.
WARRANTY DISCLAIMER. You use the Site at Your own risk. THE SITE IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. Limits of Glory MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE SITE OR ANY CONTENT OR PRODUCTS, AND HEREBY DISCLAIMS ANY IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow the disclaimer of implied warranties, so the above limitations may not apply to You.
POLITICAL DISCLAIMER Because of the historical nature of this site, there may be symbols, content, or other media that may be offensive to some, that are shown or discussed on the Site. Limits of Glory's policy is to be historically accurate, as can reasonably be expected. Some examples of offensive symbols and content, but not limited to, are swastikas, hammers & syckles, etc. If any of these symbols or content offends you, or anything related to war, wargaming, history, etc, DO NOT USE THE SITE. Should any of these symbols or content be banned in your location, DO NOT USE THE SITE. Limits of Glory does not endorse any ideology or political orientation, other than strong support for the US Connstitution, and no content or symbols should be construed in anyway of supporting any such ideology or policies.
INJUNCTIVE RELIEF. YOU ACKNOWLEDGE THAT MONETARY DAMAGES MAY NOT BE A SUFFICIENT REMEDY FOR DAMAGES RESULTING FROM VIOLATING THE TERMS OF THESE TERMS OF USE AND THAT Limits of Glory SHALL BE ENTITLED, WITHOUT WAIVING ANY OTHER RIGHTS OR REMEDIES, TO SEEK SUCH INJUNCTIVE OR EQUITABLE RELIEF AS MAY BE DEEMED PROPER BY A COURT OF COMPETENT JURISDICTION.
